A major relief for EB-5 investors—especially from India—came in November 2025 when a U.S. Federal Court struck down the steep USCIS EB-5 fee hikes introduced in 2024. The ruling immediately rolled back filing fees, making EB-5 applications more affordable once again.

The agency cited inflation and processing cost justification. But the EB-5 industry argued the increases violated the EB-5 Reform and Integrity Act (RIA 2022) which requires a proper fee-study before any hike.
On November 12, 2025, in the case Moody et al. v. Mayorkas, a Federal Judge ruled the USCIS fee rule unlawful and ordered restoration of old pre-2024 pricing.
